To answer your question, the person running the apartment’s internet service will probably get suspicious once you start downloading tons and tons of gigabytes, all of which they can’t inspect because the VPN is hiding the traffic. So will they **know** you’re using p2p connections? Maybe not. But they’ll assume you are and slap you with the fee anyway.
It doesn’t matter if what you’re doing with a p2p connection is legal or illegal. Once they see you’re doing it, they’ll hit you with the fee, and they can do so because they get to set their own policies. I’d say your best bet is trying to convince them to change their policies. Maybe focus on the Skype ban? A lot of people use it to connect with family. And show how torrenting can be useful for downloading large files in a legal way.
First off what are they intercepting your data and why do they have the authority to slap you with a few for your own account not the apartments. You actually have a binding contract for that line not the apartment.
I’m assuming you’re on PC. Didn’t For Honor get dedis enabled on PC last week with S5 update?

Windows 10 updates are default P2P so how do they deal with that?
Suggest you report everyone with Windows 10 to the very top, then you can get this stupid policy changed

A vpn hides all traffic. They would see you using a vpn and thats all. Just make sure you keep it on 24/7
Does your VPN have a kill switch? You don’t want your VPN to drop but the game continue.
