1. I think this is similar to the issue Microsoft is currently dealing with. The US govt wants access to emails stored in a datacenter in Ireland owned by MS, but it doesnt technically have jurisdiction.

   If you assume this vpn provider keeps logs, maybe you should tell us what indications you have to support that suspicion and the name of the company.

2. American VPN wise. there is only one vpn proven to not give any log data to the FBI and that is PIA.

3. Actually, the initial premise is incorrect. VPN providers, IF they have logs, would have logs for ALL activity on the central/home machine. So, even in cases where an American company has distributed servers overseas, all activities would be logged on the home/central server in the US.

   Also of note: once your data leaves the US, it is LEGALLY subject to interception/observation by the NSA (etc.) WITHOUT any warrant or legal process. If your data never leaves the US, you at least have some semblance of legal protection. (This is NOT necessarily a recommendation to use a US based VPN, but just another data point).
